OVERVIEW

Welcome to CardForge! The terms "we," "us," and "our" refer to CardForge. CardForge operates the CardForge mobile application and the website at thecardforge.app, including all related information, content, features, tools, products, and services (the "Services"). Our website is powered by Shopify.

These Terms of Service ("Terms") describe your rights and responsibilities when you use the Services. Please read them carefully, as they include important information about your legal rights, warranty disclaimers, and limitations of liability.

By using the Services, you agree to be bound by these Terms and our Privacy Policy (https://thecardforge.app/pages/privacy-policy). If you do not agree, you should not use or access the Services.

SECTION 1 — ELIGIBILITY AND ACCOUNT

You must be at least the age of majority in your jurisdiction to use the Services. By creating an account, you represent that all information you provide is accurate and complete.

You are responsible for maintaining the security of your account credentials (email, password, or linked Google account). You may not transfer, sell, or share your account with any other person. You are responsible for all activity that occurs under your account.

SECTION 2 — THE CARDFORGE APP

CardForge is a mobile application for trading card game vendors that enables importing inventory data, generating pricing labels, and printing labels via Bluetooth-connected printers.

The app is provided free to download from the Apple App Store and Google Play Store. Certain features require a CardForge Pro subscription, which is purchased through our website.

You may use the app for your own personal or business purposes in accordance with these Terms. You may not reverse-engineer, decompile, or disassemble any part of the app, except as permitted by applicable law.

SECTION 3 — SUBSCRIPTIONS AND PURCHASES

CardForge Pro subscriptions and any physical products (such as label printers and label rolls) are purchased through our Shopify-powered website at thecardforge.app.

Subscription pricing is displayed at the time of purchase. Prices are subject to change, but changes will not affect active subscription periods you have already paid for.

All payments are processed through Shopify's payment system. We do not directly collect or store your payment card information.

Purchases are subject to our Refund Policy. Physical products are subject to standard shipping terms, and delivery times are estimates only.

SECTION 4 — USER DATA AND CONTENT

You retain ownership of all data you import into the app, including CSV files, spreadsheet data, label designs, and pricing configurations.

By using the Services, you grant us a limited license to process your data solely for the purpose of providing the Services to you (e.g., generating labels, syncing data across devices). We do not use your data for any other purpose.

You are responsible for ensuring you have the right to use any data you import into the app.

SECTION 5 — BLUETOOTH AND HARDWARE

The app communicates with label printers via Bluetooth. We are not responsible for the operation, maintenance, or compatibility of third-party hardware devices. Bluetooth functionality requires appropriate device permissions, which you may grant or revoke at any time through your device settings.

SECTION 6 — INTELLECTUAL PROPERTY

The Services, including all trademarks, text, images, graphics, and the design and arrangement thereof, are owned by CardForge or its licensors and are protected by intellectual property laws.

You may use the Services for your own personal or business use only. You must not reproduce, distribute, modify, or create derivative works of any part of the Services without our prior written consent. All rights not expressly granted are reserved by CardForge.

SECTION 7 — PROHIBITED USES

You may not use the Services to: (a) violate any applicable law or regulation; (b) infringe on the intellectual property rights of others; (c) transmit malicious code, viruses, or harmful data; (d) attempt to gain unauthorized access to the Services or related systems; (e) interfere with other users' access to the Services; or (f) use automated tools (bots, scrapers, agents) to access the Services without our written consent.

We reserve the right to suspend or terminate your account if you violate these Terms.

SECTION 8 — THIRD-PARTY SERVICES AND LINKS

The Services may integrate with or link to third-party services, including Supabase (authentication and data storage), Google (sign-in), and Apple/Google (app distribution). We are not responsible for the practices or content of third-party services. Your use of third-party services is subject to their respective terms and privacy policies.

SECTION 9 — RELATIONSHIP WITH SHOPIFY

Our website at thecardforge.app is powered by Shopify. Any purchases you make through our website are made directly with CardForge. Shopify is not responsible for any aspect of sales between you and CardForge, including any injury, damage, or loss resulting from purchased products and services. You hereby release Shopify and its affiliates from all claims, damages, and liabilities arising from your purchases and transactions with CardForge.

SECTION 10 — PRIVACY

All personal information we collect is subject to our Privacy Policy (https://thecardforge.app/pages/privacy-policy). Because our website is hosted by Shopify, Shopify also collects and processes certain information about your use of the website. SECTION 11 — ACCOUNT DELETION

You may delete your account at any time from the Profile screen in the app. Account deletion will remove your authentication credentials and cloud-stored data from our servers. See our Privacy Policy for full details on data deletion.

SECTION 12 — TERMINATION

We may terminate or suspend your access to the Services at any time, without notice, if we believe you have violated these Terms. Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, and Indemnification) will continue to apply.

SECTION 13 — DISCLAIMER OF WARRANTIES

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT LABELS GENERATED BY THE APP WILL BE FREE OF ERRORS. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE ABOVE MAY NOT APPLY TO YOU.

SECTION 14 — LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, CARDFORGE, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SECTION 15 — INDEMNIFICATION

You agree to indemnify, defend, and hold harmless CardForge, Shopify, and their affiliates, officers, directors, employees, and agents from any claims, damages, or liabilities arising from: (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your use of the Services.

SECTION 16 — GENERAL PROVISIONS

Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and CardForge regarding the Services.

Assignment: You may not assign these Terms without our consent. We may assign our rights and obligations without restriction.

Governing Law: These Terms are governed by the laws of the jurisdiction where CardForge is headquartered. You consent to the jurisdiction of the courts in that location.

SECTION 17 — CHANGES TO THESE TERMS

We may update these Terms from time to time. Material changes will be communicated as required by applicable law. Your continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
